Terms of Use

These terms govern the use of the site ndlcanada.com, operated by GROUP NDL Inc., which carries on business in Canada under the name NDL Canada. By visiting the site or by sending us a form, you accept these terms. If you do not accept them, please do not use the site.

1. Purpose of the site

This site presents our industrial sourcing services, our stainless steel equipment and our kegs, and allows you to send us a quote request. It is intended for businesses and professionals. It constitutes neither an offer to sell nor a contractual commitment on our part.

2. Permitted use

You may consult the site and print extracts from it for your internal business use. You may not extract its content by automated means, attempt to circumvent its security measures, use it to send unsolicited communications, or use it in any manner that would disrupt its operation for other visitors.

3. Intellectual property

The texts, photographs, videos, diagrams and visual presentation of the site, as well as the NDL, Group NDL, NDL Tek and NDL Keg trademarks and logos, belong to us or are licensed to us. Any reproduction, dissemination or adaptation, in whole or in part, without our prior written authorization, is prohibited. Third party trademarks appearing on the site remain the property of their respective owners.

4. Accuracy of information, prices and lead times

The technical descriptions, capacities, certifications and lead times indicated on the site are provided for information purposes only and may change without notice. The 6 to 8 week lead time mentioned for factory production is an observed average, not a commitment. No prices are displayed on this site. Only a written quotation, produced by our team for a specific project, binds NDL Canada, within the limits and for the period of validity it states. In the event of a discrepancy between the site and a signed quotation, the quotation prevails.

5. Content you send us

By attaching a drawing, a photo or a technical file to a quote request, you confirm that you hold the rights necessary to disclose it to us. We use those documents solely to assess your project and produce a quotation, and we treat them confidentially. We may have to send them to our project managers and to our suppliers, including outside Canada, only to the extent necessary for pricing. The processing of personal information is described in our privacy policy.

6. Availability of the site

We make reasonable efforts to keep the site accessible at all times, without being able to guarantee it. The site may be interrupted for maintenance, updates or for a cause beyond our control.

7. Links to external sites

The site links to third party sites, including those of our partners and our divisions. We exercise no control over their content and assume no responsibility for it. Visiting a third party site is done at your sole risk and subject to the terms of that site.

8. Limitation of liability

The site is provided as is. To the extent permitted by law, NDL Canada cannot be held liable for indirect, incidental or consequential damages arising from the use of the site or the inability to use it, including any loss of profits, data or time. Nothing in this clause operates to exclude a liability that cannot be excluded under applicable law, including with respect to a consumer.

9. Governing law and competent courts

These terms are governed by the laws applicable in the province of Quebec and by the laws of Canada that apply in it. Any dispute relating to the site falls within the exclusive jurisdiction of the courts of Quebec.

10. Language

This site is offered in French and in English. In the event of a discrepancy between the two versions of these terms, the French version prevails.

11. Changes to these terms

We may amend these terms at any time. The version in force is the one published on this page, with its update date. Continuing to use the site after an amendment constitutes acceptance of the new version.
